NNP III-Estrella Mountain Ranch, LLC, NNP III – EMR 3, LLC, and NNP III-EMR 4, LLC  (collectively, “Fee Owner”) is the owner of various parcels of land comprising the Estrella (“Community”). Newland Communities is the development manager retained by the Fee Owner for the Community. Certain homebuilders unaffiliated with the Fee Owner or Newland Communities are building homes in the Community. Fee Owner and Newland Communities are not co-developing, co-building, or otherwise responsible for any of the obligations or representations of any of the Builders. Fee Owner and Newland Communities are in no way responsible for any obligations or representations of any of the Builders to third parties and/or homebuyers, and Fee Owner and Newland Communities shall incur no liability whatsoever nor have any obligations or liability to any homebuyer regarding a home purchase from a Builder. Additionally, Fee Owner may seek to qualify its Community for offering and sale of property in states where prior out-of-state registration is required before lots, parcels, or interests may be offered for sale or lease to residents of such states, which states may have specific disclosures that must be delivered to prospective purchasers before the execution of any instrument related to the sale or lease of any real property interest in the Community. Builders have been informed of such state-mandated requirements and it is the obligation of such Builders to comply with all land sale registration regulations as mandated by their contractual relationships with Fee Owner and to distribute all applicable disclosures to prospective purchasers prior to or at execution of a contract of sale for real estate. Buyers of homes from any of the Builders waive, to the fullest extent permitted by law, any and all rights, claims, causes of action, and other rights whatsoever against Fee Owner and Newland Communities arising out of their purchase transaction with the Builders.

Prices, specifications, details, and availability of a Builder’s new homes are subject to change without notice.

Certain properties may be registered with HUD, or may have registered components in the future as required pursuant to the Interstate Land Sales Full Disclosure Act. If such registration occurs, obtain the HUD Property Report, or its equivalent, required by Federal law and read it before signing anything. No Federal agency has judged the merits or value, if any, of this property.

Each Builder in the Estrella community provided the narrative that relates to such Builder. Fee Owner does not endorse and expressly disclaims any responsibility for such narrative provided by the Builders. Purchasers of Builder homes must independently investigate and judge all information provided by the Builders without any reliance on Fee Owner which entity is not affiliated with nor a part of the Builders and their businesses.

Developer may be entitled to a marketing fee from the Builder of a new home in the Estrella community, which fee may be charged back by said Builder to the purchaser of a home in the community. Prospective purchasers should check with the Builder regarding payment of the fee.

The Estrella community is intended as a community designed for Housing for Older Persons pursuant to the Housing for Older Persons Act. The community has established policies and procedures which demonstrate an intent to provide housing for persons 55 years of age or older.
